Therapy Beach Club [2021] UKPC 8 on Serious Irregularity and what it means for Hong Kong.
In that case, the Judicial Committee of the Privy Council allowed an appeal against a decision of the Bahamian
Court of Appeal. The Court of Appeal overturned the judgment of the Bahamas Supreme Court remitting an award to the arbitrator due to a serious irregularity under section 90 of the Bahamas Arbitration Act 2009.
In this session, our panelists will examine this case and the meaning of substantial injustice when it comes to serious irregularity challenges and comparing it to the current position in Hong Kong, where there is an optional challenge to awards on the grounds of serious irregularity under the Arbitration Ordinance (Cap 609).
