Prince’s Chambers barrister Olga Boltenko recently spoke at a webinar organised by the Asian Academy of International Law (AAIL) on the topic of Individual Responsibility for State Breaches of Investment Law.

The presentation was based on Ms Boltenko’s latest published paper, Can Individuals be held Accountable for Orchestrating State Breaches of International Investment Law?, which examines the contribution made by individuals to breaches of international investment law committed by States, and the extent to which those individuals may, or may not, bear responsibility for their actions under the current legal framework.

During the session, Ms Boltenko explored the absence of individual liability within international investment law and considered the legal and structural hurdles that public international law presents to any attempt to introduce such responsibility. She also discussed potential avenues through which those challenges might be addressed, contributing to an ongoing debate on the future development of international investment law.

The webinar was moderated by Dr Anthony Neoh SC, Chairman of the Asian Academy of International Law, and attracted participants from 36 jurisdictions, reflecting the broad international interest in this emerging area of legal scholarship and practice. The discussion provided an opportunity for practitioners, academics and students from around the world to engage with questions at the intersection of international investment law, public international law and accountability.
