INSIGHTS

October is proving to be a busy month for Barrister and Arbitrator Eric Ng who is contributing to a series of discussions across Hong Kong and Seoul on some of the most topical issues facing the international arbitration community today.

Serving as Vice Chair of the Ciarb East Asia Branch, Eric’s recent engagements reflect the increasingly global nature of arbitration and the growing attention being paid to procedural efficiency, technology-driven disputes and the future of dispute resolution.

On 12 October, Eric joined Gina Leung FCIArb, Chair of Ciarb East Asia Branch, for a webinar entitled “Managing Arbitrations and Procedural Orders”.

The session forms part of the Ciarb Professional Practice Guidelines on International Arbitration series jointly organised by the Ciarb East Asia, United Arab Emirates, Singapore and Malaysia branches. Bringing together arbitration professionals from multiple jurisdictions, the programme explores practical approaches to case management and procedural decision-making, both essential components of effective arbitration. The webinar highlights the increasingly collaborative nature of international arbitration and the importance of developing consistent best practices across jurisdictions.

On 20 October, Eric will participate as a commentator at the 2026 Hong Kong Summit on Commercial Dispute Resolution in China, co-organised by the Beijing International Arbitration Court Hong Kong Center and Ciarb East Asia Branch. Eric will contribute to a discussion examining: “IP Protection for AI-Generated Content, Data Rights and Virtual Spaces: Emerging Practices in the Digital Era“.

As organisations increasingly adopt artificial intelligence and digital technologies, legal systems and dispute resolution mechanisms are being challenged by questions relating to intellectual property, ownership, data rights and virtual environments. The session will explore how practitioners, businesses and tribunals are approaching these rapidly evolving issues and their implications for commercial dispute resolution.

During Hong Kong Arbitration Week on 21 October, Eric will join a panel of practitioners, consultants and in-house counsel at A&O Shearman to debate:

“Expedited Arbitration and Generative AI: A Gateway to Efficiency or a Disaster Waiting to Happen?” The discussion addresses a question currently attracting significant attention throughout the arbitration community. As arbitral institutions continue to expand expedited procedures and generative AI tools become increasingly sophisticated, the prospect of resolving disputes more quickly and cost-effectively has become increasingly realistic. At the same time, concerns remain regarding due process, procedural fairness, accuracy and enforceability.

The panel will examine whether combining expedited arbitration procedures with AI-assisted legal work can genuinely enhance efficiency without compromising the integrity of the arbitral process.

Eric’s month concludes at the Ciarb Young Members Group Conference in Seoul on 23 October, held prior to Seoul ADR Festival 2026. The conference brings together arbitration practitioners from across Asia and beyond to discuss developments shaping the future of international dispute resolution, providing another forum for cross-border collaboration and professional dialogue.

Finally, Eric has contributed to the latest issue of the Asian Dispute Review with his article “Navigating Wonderland: Common Procedural Pitfalls in International Arbitration” where he examines some of the common issues that plague parties in international commercial arbitration, leading to procedural delays and inefficiencies. As international arbitration becomes more popular and more complex, Eric’s article provides some insight on what parties can focus on to get the most out of their dispute resolution process.
